Terms and Conditions for COFFEE DRS

Welcome to COFFEE DRS STORE("we," "us," or "our"). By accessing or using our website, purchasing products, or engaging with our services, you agree to comply with and be bound by the following Terms and Conditions. Please read these terms carefully before making a purchase or using our services. If you do not agree with any part of these terms, you must not use our website or purchase from us.

1. General Information

These Terms and Conditions govern the sale of coffee beans, related products, and services (collectively referred to as "Products") by COFFEE DRS through our website, [coffeedrs.com] ("Site"). By placing an order with us, you confirm that you are at least 18 years of age and legally capable of entering into a binding contract.

2. Products and Availability

- Product Descriptions: We make every effort to ensure the descriptions and images of our coffee beans and other product/related products are accurate. However, we cannot guarantee that product descriptions or images are completely error-free.

- Availability: All Products are subject to availability. We reserve the right to limit the quantity of Products available for purchase online or discontinue products at any time without notice. Some products will only be sold in brick and mortar COFFEE DRS stores.

- Pricing: Prices for Products on our website are listed in AUD. Prices may be subject to change without notice, but changes will not affect orders that have already been processed.

3. Orders and Payment

- Order Process: Once you have selected the Products you wish to purchase, you will be prompted to provide payment and shipping information. An order confirmation will be sent to you via email upon receipt of your order.

- Payment: We accept payments through Stripe, PayPal, Credit/Debit Card. You agree to pay for all Products ordered, including applicable taxes and shipping fees if applicable.

- Order Cancellation: Orders may be canceled before shipment by contacting our customer service team at hello@coffeedrs.com within 1h of order being placed, it is your diligence to check your order before placing it. Once your order has been shipped, it cannot be canceled or changed. Unless the cancelation comes from us ( COFFEE DRS) if there is a shortage of products when sold in brick and mortal stores and stocks are not available.

4. Shipping and Delivery

- Shipping Method and Costs: Shipping fees will be calculated at checkout based on your delivery address. We offer standard and expedited shipping options. Delivery times are estimated and may vary based on your location.

- Delivery: The order will be packed within 2h to 24h after placing the order. if you have ordered on Saturday or Sunday, the order will be packed on the following business day. We will make reasonable efforts to deliver your Products within the estimated delivery time, but we are not responsible for delays caused by third parties, including shipping carriers.

- Risk of Loss: Once your order is shipped, the risk of loss or damage to the Products transfers to you.

In the event that an item is lost or damaged in the course of the Delivery Services, Coffee for the curious (Coffee DRs) asks that you:

contact the Delivery Service Provider directly to request a refund or to claim on any insurance options available; and

contact us by sending an email to coffeedrs@gmail.com outlining in what way the Products were damaged in transit and if they delivered in another address so we are able to determine if the Delivery Service Provider should be removed from the Purchase Services.

10. Governing Law and Dispute Resolution

10.1. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. By using our website and services, you consent to the exclusive jurisdiction of the courts located in New South Wales for any disputes that arise in connection with these Terms.

10.2. Dispute Resolution

We are committed to resolving any disputes with our customers in a fair and timely manner. If you have a complaint or dispute regarding your order, our services, or any aspect of your experience with COFFEE DRS , we encourage you to contact us first through our hello@coffeedrs.com to discuss the matter.

- Informal Resolution: We will aim to resolve the issue informally through direct communication. You agree to attempt to resolve any dispute amicably by engaging in good faith negotiations.

- Mediation: If a resolution cannot be reached informally, we agree to attempt to resolve the dispute through mediation. The mediator will be mutually agreed upon by both parties. Mediation will take place in New South Wales unless otherwise agreed. Each party will bear its own costs related to mediation.

- Arbitration: If the dispute is not resolved through informal communication or mediation, the dispute may be referred to arbitration under the rules of [Arbitration Body, e.g., the Institute of Arbitrators & Mediators Australia (IAMA)]. The arbitration will take place in New South Wales, and the decision of the arbitrator will be final and binding.

10.3. Exceptions

Notwithstanding the above, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property, brand, or other legal rights.

10.4. Class Action Waiver

You agree that any dispute resolution process will be conducted on an individual basis and not as part of a class, representative, or consolidated action. You waive any right to participate in any class action lawsuit against us.
